Counsel for the complainant admits that this is commercial-cum-residential property.  He had also filed the same complaint previously vide CC No. 156 of 2011.  The previous Bench passed the following order dated 19^th October 2011:-

“After arguing the matter at some length, learned counsel for the complainant seeks to withdraw the present complaint with liberty to seek his remedy in accordance with law before the appropriate court/forum. The complaint as such is dismissed as withdrawn with the liberty as aforesaid.”

        Now he wants to withdraw this Consumer Complaint with the liberty to file the same before the Civil Court or appropriate Forum.  Liberty granted, as per law.

          The case is therefore dismissed as withdrawn.
