Taken up through video conferencing.

1.       Mr. Amit Tyagi, learned counsel for the appellant submits, on instructions, that the appellant wishes to withdraw its appeal.

2.       He further submits, on his own volition, that liberty be granted to revive the appeal by filing appropriate application within 30 days from today.

3.       The instant f.a. no. 1413 of 2016 is dismissed as withdrawn, with liberty to the appellant to revive its appeal by filing appropriate application within 30 days from today.

Learned counsel for the respondent has no objection to the liberty granted.

4.       The Registry is requested to send a copy each of this Order to the parties in the appeal and to their learned counsel within three days from today. The stenographer is requested to upload this Order on the website of this Commission today itself.
