The Complainant is present through the Ld. Advocate. Ms. Moumita Chakraborty  appears on behalf of the OP/Bengal Unitech Universal Infrastructure Pvt.Ltd. by filing authorization letter. Let it be kept with the record.

Heard the Ld. Advocate appearing for the complainant and the authorized representative of the OP.  Perused the complaint petition and the relevant documents. Considered.

Authorised representative of the OP files a copy of the order  passed  by Hon’ble Apex Court  in Civil Appeal No. 10856 of 2016 (Bhupinder Singh -vs- Unitech Ltd.) where Hon’ble Apex Court has held that :-

       “Pending further orders of this Court, there shall be a moratorium against the institution of proceedings  against Unitech Ltd. and its  subsidiaries. The moratorium shall also extend to existing proceedings against the company as well as enforcement of the orders that may  have been passed against the company;”

On perusal of the record, it appears that this case has been filed against Bengal Unitech Universal Infrastructure Pvt. Ltd. which is subsidiary of Unitech Limited.

In view of the above observations of the Hon’ble Apex Court, we are unable to proceed with the matter and  we dispose of this complaint case with the above observation.

The matter is, thus,  disposed of accordingly.
