Per Shri P.N. Kashalkar – Hon’ble Presiding Judicial Member:

This Misc.Application No.2213/2007 has been filed by I.C.I.C.I. Home Finance Co., since there is delay of 92 days in filing appeal against the judgement and award passed by the District Forum, Thane in Consumer Complaint No.317/2004.  By filing this Misc.Application for condonation of delay the delay is sought to be condoned on the ground that appeal could not be filed within limitation.  In paragraph nos.3 and 4 of the condonation of delay application just and sufficient cause has been mentioned.  The Counsel for the Respondent fairly conceded that prayer for condonation of delay be allowed and he has no objection.  In the light of the said concession generously granted by the Counsel for the Complainant, we are inclined to condone the delay subject to cost.  Hence, we pass the following order:

O  R  D  E  R

    (i)               Misc.Application  No.2213/2007 for condonation of delay is allowed.

  (ii)               Subject to cost of `1,000/- payable by the Appellant to the Respondent delay is condoned.

(iii)               Cost has been paid by the Appellant to the Respondent.
