Parties under instructions state that subject matter of the present complaint has been settled between the parties in the following manner:

1.          Opposite party-builder shall hand over vacant physical possession of Penthome bearing No.PH-03(E), Type III in E Block at Palam Vihar to the complainant within a period of 30 days from today.

2.       After having taken into consideration the amounts due and payable by the complainant under the agreement to sell, the opposite party shall pay a sum of Rs.10,00,000/- (Rupees ten lakhs) to the complainant within a period of 30 days.

3.          Opposite party shall furnish a draft conveyance deed to be executed by the opposite party in favour of the complainant and on receipt of the same within a period of two weeks, the complainant shall deposit the stamp duty and registration charges with the opposite party for execution of the conveyance deed.

          The above settlement is on the facts and circumstances of this case and will not form a precedent for other cases.  Parties are left to bear their own costs. Complaint stands disposed of in above terms.
