Challenge in these proceedings is to the order dated 2.05.2012 passed by the Delhi State Consumer Disputes Redressal Commission (for short he State Commission in FA No. 983 / 2008 by which order the State Commission has dismissed the appeal of the petitioner for default in the appearance. Counsel submits that the appeal was dismissed on the first call itself and he reached the Commission a little later and requested the Commission to record his presence which was declined and, therefore, he had moved an application praying that his presence may be marked. Copy of the application has been filed as annexure P-IV (appearing at page 16 of the paper book). We are informed that certain coercive steps have been initiated by the concerned District Forum for realising its order. Since no notice on the appeal has been issued, notice to the respondents on these proceedings is not required. Having considered the entire circumstances, we allow the present petition and set aside the order dated 2.05.2012 passed by the State Commission dismissing the appeal, which will be subject to cost of Rs.5,000/- to be deposited in the onsumer Legal Aid Accountof this Commission within one week. The appeal shall stand restored on the Board of the State Commission. The petitioner is directed to appear before the State Commission on 30.05.2012. A copy of this order be given dasti.
