                                                   ORDER

The instant revision petition has been filed against the impugned order dated 13-02-2023passed by Learned District Consumer Commission, Balrampur in Complaint Case No.36/2021; M/s Ujjwal Namkeen Vs Allahabad Bank & Another.

Heard Miss Sumayya Kidwai, Counsel for the revisionist and on behalf of complainant/opposite party no.1 Sri Satya Prakash Pandey and Sri Saket Srivastava for opposite party no.2 Allahabad Bank.

I have gone through the order dated 13-02-2023 passed by the Learned District Consumer Commission, this fact cannot be disputed that the period for filing the written statement has already expired, therefore, the Learned District Consumer Commission has not accepted the written statement beyond the time framed under the provisions of law is fully justified, however, in the interest of justice seeing the peculiar facts and circumstances of the case that the counsel for the insurance company had died during the pendency of the instant complaint. In the interest of justice an opportunity of producing/filing the evidence by both the parties is allowed. The impugned order dated 13-02-2023 is set-aside and the Learned District Consumer Commission will proceed in

accordance with law and decide the complaint expeditiously preferably within a period of one year from the date of the production of the certified copy of this order.

Let copy of this order be made available to the parties as per rules.
