We have considered the case in the totality of the facts and circumstances and we find that the product was beyond the period of warranty and TV set was examined on the request of complainant. Also, the complainant has not placed any expert opinion on record to prove that OP has sold the product having manufacturing defect. Further, the OP has immediately attended the complaint of the complainant and apprised him about the status of the product. Therefore, by no stretch of imagination of OP can be held liable for either deficiency in service or selling a defective product to the complainant. The complaint miserably fails which is devoid of any merits and is dismissed. Ordered accordingly.”
