Complainant and Manager of Op are present.   The Manager of Op submitted that Op is prepared to give a new set as a substitute to the old one for the same cost and of the same brand.  The complainant has chosen ELM set which is said to be the same cost of the set he purchased and he opts to have that set as substitute to the old one.    The representative of the Op agreed to supply the same.   With this, we dispose off the complaint accordingly.   As the result, we pass the following order.

O R D E R

        Compliant is allowed.  Op is directed to supply a brand new mobile hand set called ELM in a sealed box within 20 days from the date of this order.  Failing which, Op shall refund Rs.8,979/- with interest @ 8% p.a from today till the date of payment

        Under the circumstances of the case, both parties are directed to bear their own cost.
