Application under Section 25/27 of Consumer Protection Act, 1986 (now amended under Section 72 of Consumer Protection Act, 2019).

Present:  None for the DH.

                                                         

                Today the execution application is fixed for appearance of the JDs through arrest warrant. Warrant of arrest could not be issued due to non filing of the correct address. None has put into appearance on behalf of the DH. The present execution application pertains to year 2018 and same is still at the stage of preliminary hearing i.e. notice to the JDs. DH has already availed several opportunity to file the correct address of the JDs. Case called several times since morning but none has put into appearance on behalf of the DH. It is already 03:15 PM. It appears that DH is no more interested to pursue his case. Further adjournment for the same purpose would not be justified at it would amount to wastage of precious time of this Commission.

                Hence, in view the above facts, the present execution application is hereby dismissed. However, DH/complainant is at liberty to file fresh execution application on the same cause of action on filing the correct addres of the JDs, if so desired. Parties concerned be communicated of the order accordingly and file be consigned to the record room.
