            Shri R. B. Tiwari, learned counsel for the appellant.

            Shri Akash Sahu appears on behalf of Shri Pushpendra Singh, learned counsel for the respondent no.1.

            None for the respondent no.2 & 3.

                       

As per Shri Justice Shantanu S. Kemkar :                       

            This appeal arises out of the order dated 09.05.2017 passed by the District Consumer Disputes Redressal Commission, Jabalpur (for short ‘District Commission’) in C.C.No.694/2016 whereby the District Commission has dismissed the complaint for want of prosecution.

2.                For the reasons stated in the appeal, we find that there was sufficient cause for absence of complainant/appellant and his counsel before the District Commission, when the case was called. In the circumstances, by condoning the absence of complainant/appellant, we restore the complaint to its original number by setting aside the impugned order.

3.                Parties are directed to appear before the District Commission on 03.08.2022.

4.                With the aforesaid directions, the appeal is disposed of.
