CONSUMER COMPLAINT NO. 949  OF  2021

AWARD

1.        Case taken up today in Grahak Madhyastata Samadhan and the parties have settled the matter. Vide his separate statement, Sh.Devinder Kumar, Counsel for OP No.1, under the instructions of the OP No.1, has stated that the OP No.1 is ready to refund invoice amount of Rs.15499/- to the complainant, towards full and final settlement of the present consumer complaint, within 30 days from the date of receipt of the certified copy of the order. He has further stated that the box and accessories, if any, lying with the complainant shall be returned to OP No.1. Vide his separate statement, Sh.Gaurav Bhardwaj, Counsel for Complainant has admitted the statement of counsel for OP No.1 and prayed that the complaint be disposed off in terms of said settlement. He has further stated that the watch in question is already lying with the OP No.1.

2.        In view of the aforesaid statements and in terms of the settlement, the complaint stands disposed off by passing the following order:-

     (i)  OP No.1 is directed to refund invoice amount of      Rs.15499/- to the complainant within 30 days from the    date of receipt of the certified copy of this order.

     (ii) In case the aforesaid amount is not paid by the OP   No.1 within the stipulated period, then OP No.1 shall be    liable to pay the same alongwith interest @ 9% p.a. from     the date of filing of present consumer complaint i.e.     27.12.2021 till its realization.

     (ii) The box and accessories of the watch, if any, lying with the complainant shall be returned to OP No.1.

3.   The award is accordingly passed.

4.   Certified copies of this order be sent to the parties free of cost. The file be consigned.
