2.                M/s. Sahara Credit Cooperative Society Limited, 100 Feet Road, Ballabgarh – 121004 through its Branch Manager/Authorised Signatory Mr. Ram Chandra.

                             Opposite parties Nos.1 & 2 ex-parte vide order dated 16.09.2022.

 

ORDER:  

                   The facts in brief of the complaint are that  believing on “Sahara Brand” complainant agreed to obtain Sahara I. Select” bond vide account No. 24777200334 dated 14.09.2018, membership No. 24371800015 Certificate No. 715000242223 and complainant deposited an amount of Rs.5000/-.  However, at that time, opposite parties executive also assured that during the scheme period, whenever, complainant would be required money, then  she would have the right to withdraw entire deposited amount with interest. The maturity date of said bond was 14.09.2021.  After maturity complainant visited the opposite parties branch office time to time and requested to them to release the deposit amount alongwith the interest, but they had been delaying the matter on one pretext or the other.   The complainant sent legal notice  dated 027.05.2022 to the opposite parties but all in vain. The aforesaid act of opposite parties amounts to deficiency of service and hence the complaint.  The complainant has prayed for directions to the opposite parties to:

a)                release the deposited amount alongwith interest @ 24% p.a.

 b)                pay Rs. 50,000/- as compensation for causing mental agony and harassment .

c)                 pay Rs. 11,000 /-as litigation expenses.

2.                Case called several times since morning but none appeared on behalf of opposite parties.  Therefore, opposite parties were proceeded against exparte vide order dated 16.09.2022.                     

3.                The complainant led evidence in support of his respective version.

 

4                  We have heard learned counsel for the complainant and have gone through the record on the file.

5.                In this case the complaint was filed by the complainant against opposite parties – M/s. Sahara Credit Cooperative Society Ltd. & another with the prayer to : a)  release the deposited amount alongwith interest @ 24% p.a. b)    pay Rs. 50,000/- as compensation for causing mental agony and harassment . c)         pay Rs. 11,000 /-as litigation expenses.

                   To establish his case, the complainant  has led in his evidence Ex. CW/A – affidavit of Shri Tajender,, Ex.C-1 – photocopy of certificate No. 715000242223, Ex.C-2 – legal notice, Ex.C-3 & 4 – postal receipts.

6.                There is nothing on record to disbelieve and discredit the aforesaid ex-parte evidence of the complainant. Since opposite parties Nos1 & 2 have not come present to contest the claim of the complainant, therefore, the allegations made in complaint by the complainant go unrebutted. From the aforesaid ex-parte evidence it is amply proved that opposite parties Nos.1 & 2 have rendered deficient services to the complainant. Hence the complaint is allowed against opposite parties Nos.1 & 2

7.                Opposite parties Nos.1 & 2 jointly & severally, are directed to:

a)                pay the deposited amount @ 6% p.a. from the date of filing of complaint till its realization.

b)                 pay Rs.2200/- as compensation for causing mental agony  & harassment.

c)                pay Rs.2200/- as litigation expenses to the complainant. 

Compliance of this order  be made within 30 days from the date of receipt of copy of this order.  Copy of this order be sent to the parties concerned free of costs.   File be consigned to the record room.
