Complainant filed an amendment petition which is treated as an M.A. No. 73/2023. In the said petition Complainant submits that the execution proceeding being E.A. No. 273/2013 arising out in C.C. /52(S)/2009. The petition is taken up today for hearing. Heard and considered.
The Dhr filed an amendment application for amendment of award dated 11/10/2010 and execution proceeding being E.A. No. 273/2013 which is still pending. The M.A. petition is taken up today for hearing. The Complainant submits mistaken in the Cause Title of award dated 11/10/2010 of C.C./52(S)/2009 and in E.A. case being address of the Complainant would be ‘T-83 of the Rajarhat Road,’ instead of ‘T-63 Rajarhat Road.’
We are in view that at this stage, it would not wise to amend the M.A. application being No. 73/2023. Though it is not the address of premises in question. Heard the amendment petition. Considered and rejected.
Hence, the M.A. being No. 73/2023 is disposed of.
