   Complainant had purchased some sanitary commodities  from the 1st opposite party which was manufactured by the 2nd opposite party.  The representative of the 1st opposite party approached the complainant and offered the  supply of various building construction materials at the  work site of the  complainant’s home.  After showing the photographers and brochures of various  items the complainant ordered some commodities including 3 nos. of closets in the brand  name PREMIA CCINTS/SEAT with soft close seat cover No.5011.  On 5/9/2015 the 1st opposite party delivered 3 Nos of closets.  The 1st opposite party’ men  brought all items and  stored in the nearby constructing  house, without removing  the safety packing .  The complainant opened the  packet for installation, one of the closet was seen  broken.  This matter was duly  informed  to the  1st opposite party and requested for replace the same.  Even after repeated demand the opposite party did not  replace the same..  After a few months  one of the representative of the 1st opposite party come and inspected the broken  article and promised to replace the same, but  the 1st opposite party never replaced the same.  The complainant purchased the same  item and completed the work.  The 1st opposite party supplied  damaged closet  to the complainant and  not  willing to replace  same is a deficiency in service.  Hence the complainant approached the   before the Forum for getting  compensation  for mental and financial loss  caused to him. 

  2.  Inspite of the notice from the Forum neither  the opposite parties are not turn up nor filed any written version , they remained absent  and set exparte.

3.    The point for consideration is whether there  is  any deficiency in service on the part of opposite party and if so  for what  relief  the complainant is entitled to ?

4.   The evidence consist of oral testimony of  Exts.P1 to P3 marked from the side of the  complainant. 

5.The point:  The complainant examined as PW1.  PW1 purchased some sanitary items   from the 1st opposite party which was manufactured by the 2nd opposite party.  The representative of the 1st opposite party approached the complainant and offered and delivery of the sanitary  items in the    work site of the  complainant. Ext. P1 is the  purchase bill.  On 5/9/2015 ,the 1st opposite party delivered the articles  which was kept  nearby the  constructing  building, without removing  the safety pack .  While the complainant opened the  packet for installation, one of the closet was seen  in broken condition.  This matter was duly  informed  to the  1st opposite party and requested for replace the same.  Even after repeated demand the opposite party did not  replace the same.   After a few month later   one of the representative of the 1st opposite party come and inspected the broken  article and promised to replace the same, but  till now  it was not replaced.  Hence the complainant purchased the same  item and completed his work  Ext.P3 is the photographs .  We find that the  1st opposite party supplied  damaged closet  and  not  willing to replace  same is a gross  deficiency in service and remained  absent before the Forum  to  contest the  matter.  Hence the complainant should be compensated.

    In the result complaint is allowed.  The 1 st opposite party is directed to  refund  Rs.8999/- the cost of the  broken closet  with interest at 9%  and  also directed to  pay Rs.10,000/-  as cost and compensation to the complainant within 30 days  from the date of receipt of copy of this order.  Failing which 1st  opposite party shall pay 12% interest to the above said amount  from the  date of default  till realization.
