The Complainant is present by filing hazira.

The case is fixed for filing Written Version I/D Ex-parte hearing.

None of O.P. No.1 & 2 turns up and files any W.V. to contest the case.

The case is therefore taken up for Ex-parte hearing.

The Complainant’s case is that he purchased a Mixer Grinder machine on     14-06-2020 for Rs.3,250/- with two years’ Warrantee but after purchase it was found defective and an advocate’s letter was served upon the O.P. on 29-07-2022 for redressal of  relief but nothing has been done by any of the O.P.s either by replacing the defective product or refunding the price thereof.

Considering the urgency of the matter and nature of the case the Commission passed an interim order dated: 19-09-2022 by directing the O.P.s to either replace the defective Mixer Grinder machine or to refund the price of the same within a month from the date of the order in default the Commission will not spare the O.P.s for adequate compensation for harassment already caused to the Complainant.

O.P. No.1 is the Dealer and O.P. No.2 is a reputed Manufacturing company. But their role is very dissatisfactory to the Commission in complying with the order by the Commission. Had the O.P.s any defence they would have come forward to contest the case by filing W.V. The absence of the O.P.s and their act and conduct and attitude suggests that a defective product of Mixer Grinder has been supplied to the Complainant without taking any care of its proper service and maintenance.

 It is a fit case to pass an effective order for redressal of grievances of the Complainant.

Taking consideration into the entire facts and circumstances of the case and bona fide claim of the Complainant the Commission hereunder proceeds to dispose of the case by directing both O.P.s to jointly and severally refund of Rs.3,250/- as the price of the Mixer Grinder machine to the Complainant along with Compensation of Rs.10,000/- within a month from this date in default the complainant may recover decretal amount in due process of law.

Both parties be supplied copy of this judgement free of cost.
