
Mr. Abhinav Gupta filed a consumer case on 07 Apr 2017 against M/s Omaxe Chandigarh Extension Developers Pvt. Ltd. in the StateCommission Consumer Court. The case no is CC/721/2016 and the judgment uploaded on 10 Apr 2017.
At the time of arguments the matter has amicably been settled between the parties. It is stated by Sh. Munish Gupta, Advocate, Counsel for the Opposite Parties that an amount of Rs.16,22,879/- shall be returned to the complainant with interest @8% p.a. whereof 26.05.2017. The entire amount shall be paid in two installments and interest will be paid on decreasing balance. It is stated that post-dated cheques, one encashable on 07.05.2017 and another on 07.06.2017 shall be handed over to the complainant/his Counsel within 15 days from today. On getting instructions from Sh. Laksh Bir Gupta, father of the complainant, Counsel for the complainant states that the proposal made is acceptable to the complainant.
In view of above, this complaint stands disposed of.
However, it is made very clear that in case any of the cheques bounced, the complainant will intimate the Opposite Parties on the following telephone numbers :-

On receipt of intimation, the amount qua the cheque shall be paid within five working days through demand draft, failing which, the complainant will be entitled to get further cost of Rs.20,000/- for each default. In case, the amount is not paid, as agreed, the order passed will be treated as an executable decree and it will be opened to the complainant to get it executed, as per law.
