None appears for complainant.  On the contrary counsel for opposite party is present and submits that, matter is pending  consideration of I.A. filed by the Opposite party under  order VII Rule 10 of CPC for return of the complaint for want of pecuniary jurisdiction.  This complaint is filed on 10.10.2018 through learned counsel.  The opposite party has submitted version and the matter is set for holding an enquiry and in the meantime I.A. came to be filed for return of complaint presented by complainant Nos.1 to 3.  It is to be noted herein that, complainant remained absent on all the effective hearing dates, in such circumstances, with no option Commission proceed to dismiss the complaint for default and for non-prosecution.
