Sachin Kakkar filed a consumer case on 24 May 2018 against M/s Manohar Infrastructure and Constructions Private Limited in the StateCommission Consumer Court. The case no is CC/861/2017 and the judgment uploaded on 07 Jun 2018.
As per office report, rejoinder filed by the complainant in the office of this Commission, which is taken on record. Copy of the same has already been supplied to the Counsel opposite.
The matter has amicably been settled between the parties.
It is stated by Sh.Dipinder Singh, Advocate, proxy for Sh.I.P.Singh, Advocate, Counsel for the Opposite Party on getting instructions from Sh.Arvinder Singh, Company Secretary that the principal amount of Rs.21,20,000/- shall be returned to the complainant alongwith interest @7% p.a. (simple) from the date of respective deposits made. The payment shall be made in the following manner :-
1st Installment | - | 25% of the principal amount + interest on the said amount of 25% from the respective date of deposit till 15.07.2018. Demand draft qua the aforesaid amount shall be handed over on 16.07.2018. |
2nd Installment | - | 25% of the principal amount + interest on the said amount of 25% from the respective date of deposit till 15.08.2018. Demand draft qua the aforesaid amount shall be handed over on 16.08.2018. |
3rd Installment | - | 25% of the principal amount + interest on the said amount of 25% from the respective date of deposit till 15.09.2018. Demand draft qua the aforesaid amount shall be handed over on 16.09.2018. |
4th Installment | - | 25% of the principal amount + interest on the said amount of 25% from the respective date of deposit till 15.10.2018. Demand draft qua the aforesaid amount shall be handed over on 16.10.2018. |
The abovesaid offer is acceptable to the Counsel for the complainant.
In view of above, this complaint stands disposed of having become infructuous.
However, we make it very clear that in case, any default is committed in making the payment, as referred to above, for each default, on the defaulted amount, the complainant shall continue to get interest at the rate referred to above till the time of making the payment. Further for each default, the complainant shall be entitled to penal amount of Rs.20,000/-. Further, it is made clear that this order shall be treated as an executable decree and if need be, it shall be open to the complainant, in case of not making the payment, as committed, to get it executed, as per law.
