ORDER
Vakalatnama filed on behalf of the Opposite Parties, which is taken on record.
The matter has amicably been settled between the parties.
It is stated by Sh.I.P.Singh, Advocate, Counsel for the Opposite Parties that the principal amount of Rs.22,50,000/- shall be returned to the complainant in twelve monthly equated installments of Rs.1,87,500/- each, alongwith interest @7% p.a. (simple) from the date of respective deposits made. The payment shall be made in the following manner :-
1st Installment | - | Rs.1,87,500/- + interest on the said amount of Rs.1,87,500/- from the respective date of deposit till 11.10.2018. Demand draft qua the aforesaid amount shall be handed over on 12.10.2018. |
2nd Installment | - | Rs.1,87,500/- + interest on the said amount of Rs.1,87,500/- from the respective date of deposit till 11.11.2018. Demand draft qua the aforesaid amount shall be handed over on 12.11.2018. |
3rd Installment | - | Rs.1,87,500/- + interest on the said amount of Rs.1,87,500/- from the respective date of deposit till 11.12.2018. Demand draft qua the aforesaid amount shall be handed over on 12.12.2018. |
4th Installment | - | Rs.1,87,500/- + interest on the said amount of Rs.1,87,500/- from the respective date of deposit till 11.01.2019. Demand draft qua the aforesaid amount shall be handed over on 12.01.2019. |
5th Installment | - | Rs.1,87,500/- + interest on the said amount of Rs.1,87,500/- from the respective date of deposit till 11.02.2019. Demand draft qua the aforesaid amount shall be handed over on 12.02.2019. |
6th Installment | - | Rs.1,87,500/- + interest on the said amount of Rs.1,87,500/- from the respective date of deposit till 11.03.2019. Demand draft qua the aforesaid amount shall be handed over on 12.03.2019. |
7th Installment | - | Rs.1,87,500/- + interest on the said amount of Rs.1,87,500/- from the respective date of deposit till 11.04.2019. Demand draft qua the aforesaid amount shall be handed over on 12.04.2019. |
8th Installment | - | Rs.1,87,500/- + interest on the said amount of Rs.1,87,500/- from the respective date of deposit till 11.05.2019. Demand draft qua the aforesaid amount shall be handed over on 12.05.2019. |
9th Installment | - | Rs.1,87,500/- + interest on the said amount of Rs.1,87,500/- from the respective date of deposit till 11.06.2019. Demand draft qua the aforesaid amount shall be handed over on 12.06.2019. |
10th Installment | - | Rs.1,87,500/- + interest on the said amount of Rs.1,87,500/- from the respective date of deposit till 11.07.2019. Demand draft qua the aforesaid amount shall be handed over on 12.07.2019. |
11th Installment | - | Rs.1,87,500/- + interest on the said amount of Rs.1,87,500/- from the respective date of deposit till 11.08.2019. Demand draft qua the aforesaid amount shall be handed over on 12.08.2019. |
12th Installment | - | Rs.1,87,500/- + interest on the said amount of Rs.1,87,500/- from the respective date of deposit till 11.09.2019. Demand draft qua the aforesaid amount shall be handed over on 12.09.2019. |
The abovesaid offer is acceptable to the Counsel for the complainant.
In view of above, this complaint stands disposed of having become infructuous.
However, we make it very clear that in case, any default is committed in making the payment, as referred to above, for each default, on the defaulted amount, the complainant shall continue to get interest at the rate referred to above till the time of making the payment. Further for each default, the complainant shall be entitled to penal amount of Rs.20,000/-. Further, it is made clear that this order shall be treated as an executable decree and if need be, it shall be open to the complainant, in case of not making the payment, as committed, to get it executed, as per law.
It is made clear that on or before getting last payment, the original document shall be surrendered by the complainant to the Opposite Parties.
Certified copies of this order be sent to the parties, free of charge.
