Madhur Ganga Vs M/s.Malhotra Enterprises & ors

Present:- None.

Case called several times, but today neither the complainant nor anybody else on his behalf has come present.

As per report of Ahlmad, Notice was sent to OPs No.1 to 3 and was received back with report that “Owner of this office, Amarjit Malhotra has died”. Sh.Amarjit Malhotra, Proprietor of OP No.1 & OP No.2 has died, no L.R of OP No.1 & OP No.2 has been impleadd by the complainant nor any application has been moved. The complainant has impleaded OP No.3 as Proprietor of the firm M/s.Malhotra Enterprises whereas OP No.1 & OP No.2 is also the same firm. There cannot be two Proprietor as mentioned in the complaint. Moreso, the complainant has not furnished correct address of OP No.3 since 11.3.2024 till today inspite of availing number of opportunities. It seems that the complainant is not interested in persuing the case. Hence, the present complaint is dismissed U/o 9 rule 2 CPC for non-filing correct address of OPs. File be consigned to the record room.
