Anita Vs.M2M

Present:          Sh.Parveen Kumar, Advocate for DH.

                        Sh.Lalit Nayyar Advocate for JD No.1.

                        An application for settlement was filed by the JDs on dated 15.11.2021.

                        Ld. Counsel for the DH made a statement that DH has settled the matter with the JD and has received a DD no.774388 dated 17.12.2021 amounting to Rs.500000/-(Rupees five lac only) from the judgment debtor. On the direction of the DH, he withdraws the present execution being fully satisfied.   

            In view of the statement made above, present execution stands dismissed as withdrawn being fully satisfied.

                        In the present execution property of JDs was attached vide order dated 17.03.2021 of this of this Commission and intimation of the same was given to the office of Tehsildar by this office.  In return, a confirmation report  dated 26.08.201 was issued by Tehsildar Sampla to the effect that the land comprised in Rectangle no.68 Killa No.9(8-0), 10(8-0), 11(8-0) and Rectangle No.69 Killa No.6(8-0) 14(8-0), 15(8-0), 16/1(6-0) 25/2(5-7)  total 59K-7M or 7.418 Acres situated at village Kheri Sadh Tehsil Sampla District Rohtak was attached. Now Tehsildar, Sampla is directed to release the alleged property of JDs attached against execution no.123/19 in case titled as Anita Kumari Vs. M2M.  Assistant is directed to send a separate letter in this regard to the Tehsildar Sampla.

Copy of this order   be  supplied to both the parties    free of  cost.    File be consigned to the record after due compliance.
