Present:          Shri S.S.Gehlawat, Advocate for DH.

                        Sh.Lalit Nayyar, Advocate for JD No.1.

                        Sh. Rajesh Sharma Advocate for JDs No.2D and 2E.

                        Sh. K.S.Narang Advocate for JD No. A to F.

 

                        File taken up today on the application of JD No.1 for filing accompanied application for payment and declaration alongwith this application. But no application for payment and declaration has been placed on record. Ld. Counsel for the DH made a statement that he withdraws the present execution and the same be consigned to the record room.

                        In view of the statement made by ld. counsel for the DH, present execution is hereby dismissed as withdrawn.

                        In the present execution property of JDs was attached vide order dated 21.12.2020 of this Commission and intimation of the same was given to the office of Tehsildar vide letter no.586 dated 23.12.2020 of this office.  In return, a confirmation letter No.41 dated 07.01.2021 was issued by Tehsildar Sampla to the effect that the  land comprised in Rectangle no.68 Killa No.9(8-0), 10(8-0), 11(8-0) and Rectangle No.69 Killa No.6(8-0) 14(8-0), 15(8-0), 16/1(6-0) 25/2(5-7)  total 59K-7M or 7.418 Acres situated at village Kheri Sadh Tehsil Sampla District Rohtak was attached. Now Tehsildar Sampla is hereby directed to release the alleged property of JDs attached against execution no.88/2019 in case titled as Ajay Vs. M2M. Assistant is directed to send a separate letter in this regard to the Tehsildar Sampla.
