Present:        Shri S.S.Gehlawat, Advocate for DH.

                        Sh.Lalit Nayyar, Advocate for JD No.1.

                        Sh. Rajesh Sharma Advocate for JDs No.2D and 2E.

                        Sh. K.S.Narang Advocate for JDs.

 

                        File taken up today on the application of JD No.1 for filing accompanied application for payment and declaration alongwith this application. But no application for payment and declaration has been placed on record.  However, Ld. Counsel for the DH made a statement that he withdraws the present execution and the same be consigned to the record room.

                        In view of the statement made by ld. counsel for the DH, present execution is hereby dismissed as withdrawn.

                        In this execution property of JDs was attached vide order dated 06.08.2019 of this Commission and confirmation of attachment of property was given by the bank vide letter dated 17.08.2019 of Oriental Bank of Commerce to the effect that FDR Account No.08443031130476 in Oriental Bank of Commerce, DDA market, Vashundhra Enclave, Delhi-110096 in the name of JDs was attached. Now the Branch Manager, Oriental Bank of Commerce, DDA market, Vashundhra Enclave, Delhi-110096 is hereby directed to release the alleged property of JDs attached against execution no.157/2018 in case titled as Rajesh Vs. M2M. Assistant is directed to send a separate letter in this regard to the Branch Manager. File be consigned to the record room after due compliance.
