Counsel for the Complainant heard. He submits that the complainant has paid a sum of Rs. 30, 00,000/- only which does not come to the jurisdiction of this Commission. He submits that he has claimed a sum of Rs. 1,50,00,000/- in view of the market value of the plot. The Commission is not to see that what is the present value of the plot. The Commission can grant reasonable interest or reasonable compensation. See Law laid down by the Apex Court in “Sinco Industries Versus State Bank of Bikaner & Jaipur and Others” [(2002) 2 Supreme Court Cases 1]. Even if this case is decided by the State Commission and the amount exceeds Rs.1,00,00,000/- (one crore), there lies no rub. After this, the complaint wants to withdraw this case and wants to file the case before the State Commission. The case stands dismissed as withdrawn. The liberty is given to file the case before the State Commission as per Law. As prayed, the complainant be given back the fees in the sum of Rs. 5,000/-. |
