          On 21.10.06 the complainant has purchased one microwave oven from 3rd respondent for Rs.12,700/-. It was made to believe that the 2nd respondent is the authorized service unit and repair can be done at 2nd respondent customer care. After the purchase of 3 weeks the machine showed defects and when intimated to respondents-2 and 3 they have sent a mechanic and repaired and again became defective. The complaints were repeated and Rs.3871/- was spent for repair. Even after this the defects again continued and entrusted the oven with 3rd respondent. The 3rd respondent during pooja holidays given another oven and when bill had asked it was not given. The new oven was also defective. Hence the complaint.
 
          2. The respondents called absent and set exparte.
 
          3. The complainant filed affidavit and Exts. P1 to P6 documents to prove his case.
 
          4. The complaint is filed alleging defect to the microwave oven purchased from 3rd respondent. It is the case that the oven purchased was defective and the defects were not cured even after repairs and at last entrusted the same with 3rd respondent. It is also stated that another oven given by 3rd respondent which was also defective. According to the complainant these are unfair trade practice of respondents. Since there is no evidence to the contrary the complaint is liable to be allowed.
 
          5. In the result the complaint is allowed and the 3rd respondent is directed to return Ext. P2 amount of Rs.12,700/- (Rupees twelve thousand and seven hundred only) to the complainant and the 1st and 2nd respondents are directed to return Ext. P6 amount of Rs.3871/- (Rupees three thousand eight hundred and seventy one only) and all the respondents are further directed to pay Rs.5000/- (Rupees five thousand only) as compensation within two months from the date of receipt of copy of this order. After complying the order the 3rd respondent can take back the microwave oven kept with complainant.
