According to the complainant, soon after its purchase, the machine started giving problem as its spin dryer stopped working.   The complainant also served a legal notice dated 16.11.2012 upon the opposite parties asking them to replace his washing machine but to no avail.

5.                      The contention of the complainant is that soon after purchase the machine started giving problems which could not be set right despite many requests.

“During the pendency of the complaint, the washing machine in question was repaired by replacing spin card.   

In this view of the matter, the primary grievance of the complainant with regard to defect in the washing machine is settled. Otherwise also, it is now settled law that if the defect can be rectified by removal of certain part(s) there is no need to change the machine as a whole.

i)            To pay Rs.7,000/- as compensation for mental agony and harassment caused to the complainant;

ii)          To pay Rs.5,000/- as litigation costs.
