The Brief fact of the Complainant is that the Complainant had purchased four numbers of used motorcycles with a promise to get the ownership transferred in the name of the Complainant without any extra charge from the OP for a consideration of Rs. 1,52,236/- dt. 4.6.2-021, out of which advance Rs. 5000/- was paid in cash vide their money receipt no. 2723 dt. 28.05.21 and rest amount of Rs. 1,47,236/- was electronically transferred to the OP’s bank account. The OP assured the Complainant that within 30 days of sale of these motorcycles he would get the ownership transferred in the name of the Complainant but they are not initiating the transfer of ownership of the said vehicles. The Complainant has reported the matter to the OP several times but no reply of the same. Hence this case.
  2. The OP is set-exparte.
  3. From the version and submission of the parties and from the documents it is observed that the OP assured the Complainant that within 30 days of sale of the motorcycles, he will get the ownership transferred in the name of the Complainant but they have not transferred the ownership of the said vehicles. Hence deficiency in service found against the OP.

Accordingly, the OP is directed to transfer the ownership of the said four numbers of vehicles, to pay Rs. 50,000/- for the damage, suffering and mental agony caused to the complainant for not transfer of the vehicles and Rs. 10,000/- towards litigation expenseswithin 30 days from the receipt of this order.

Order pronounced in the open Court today on 22th day of Jan, 2024.
