          The complainants have filed the instant complaint under Section 17 of the Consumer Protection Act, 1986, wherein they have sought the following reliefs:-

(a)     direct the opposite parties to deliver the possession of the allotted apartment in the project PALM HILLS after fully completing it and after constructing all the basis development works;

(b)     grant pay reasonable compoundable interest on the deposited amount of Rs.62,43,703/- as this Hon’ble Commission deems fit in the facts and circumstances of the case from the dates of deposit of the amounts;

(c)     grant compensation of Rs.5,00,000/- for inconvenience, mental harassment and damages suffered by the complaints due to deficiency of services on part of the respondents;

(d)     grant compensation of Rs.20,000/- towards the costs of litigation, documentation charges, representations and numerous visits;

(e)     any other relief to which the complainants may be entitled to under the facts and circumstances of the matter be passed in favour of the complainants and against the opposite parties.

 

2.      Upon notice, the opposite parties put in appearance and filed their written version. Both the parties thereafter led their respective evidence.

3.      At this stage, Shri B.S. Walia, counsel for the complainants states that the matter between the parties has been amicably settled. In this regard, he has placed on record copy of the settlement agreement.

4.      Learned counsel for the opposite parties confirms the factum of compromise arrived at between the parties.

5.      In view of the above, the complaint is hereby dismissed as withdrawn in view of the settlement arrived at between the parties. The parties shall remain bound by the terms and conditions of the settlement agreement.
