Sh. Ashim Aggarwal, Advocate, Counsel for the Opposite Party has placed on record copy of letter dated 20.1.2016 intimating the complainant to get possession of the built-up unit, detail of amount to be paid by the complainant to the Opposite Party and by the Opposite Party to the complainant as given at Page 2 of this letter. He states that possession is ready. As and when the complainant approach the Opposite Party, possession will be delivered immediately.
2. Sh. Govind Korla, Advocate, Counsel for the complainant states that under the terms and conditions stated in the above letter, he will approach the Opposite Party to get possession.
3. It is further agreed between the parties that statutory expenses like registration of sale deed, stamp duty etc. shall be paid by the complainant as and when the sale deed is registered. The complainant further agreed that he will pay maintenance charges and interest free maintenance security (IFMS) on or before 01.03.2016. Water charges shall also be paid for the water used after taking possession.
4. Price of additional area stands waived of by the Opposite Party.
5. It is further agreed that an amount of Rs.2,73,884/- shall be paid by the Opposite Party to the complainant within one month from the date of taking possession. Over and above the said amount, the Opposite Party shall pay litigation expenses of Rs.40,000/- to the complainant.
6. It is stated by Sh. Ashim Aggarwal, Advocate, Counsel for the Opposite Party that the compromise may not be taken as precedent in cases in future.
7. The compromise has been got recorded on the instructions from Sh. Gurdeep Singh, Senior Manager (Legal) of the Opposite Party.
8. In the above said terms, this complaint stands disposed of.
9. Certified copies of the order be sent to the parties free of charge.
10. File be consigned to the Record Room after completion.
