Order No. 04, Dated: 22.12.2021
Today is fixed for admission hearing. No step is taken by the complainant. On repeated calls, none appeared on behalf of the complainant. It is now 2.10 pm; the record is taken-up on the point of admissibility of this case.
Perused the complaint and Xerox copy of document so filed by the complainant, it appears that the complaint has been filed on 02.12.2021 since then complainant has been given two opportunities for admission hearing but he did not take part this day for admission hearing. On perusal of the complaint, it appears that he approached the respondent in order to avail the respondents service for a course on design engineer master’s certification program and the complainant had disburse the amount of rupees fifty thousand including GST for the course through invoice dated 28.04.2021 and invoice No.SL21/W/04/2429 but the O.P. informed the complainant that the total cost of rupees was one lakh seventy thousand and the respondent had vailed a loan against the complainant through loan account number-06700110123485.
As the complainant had failed to provide the complainant with genuine study materials complainant asked to the respondent for the refund of the amount. Upon this background he has filed this case praying for refund the said money and compensation of rupees twenty five thousand, but the complainant did not file any document to show that he had disbursed an amount of rupees fifty thousand in favour of the respondent even he did not file any paper invoice number in support of his claim. By sending notice for compensation, for deficiency of service cannot support his case for disbursement of rupees fifty thousand to the respondent. Upon this background, we find no prima facie case for admission of the same.
Hence, it is
O r d e r e d
that this case is not admitted and thus disposed of.
Let a plain copy of this order be supplied to the complainant fre of cost as per provisions of law.
