(1)     None is present for the complainant.  Adv.Vinod Suryavanshi is present for the opponent no.2. 

(2)     In the morning session, Adv.Mohammad Hussain appeared for the complainant and stated that he is unable to file expert evidence on the manufacturing defect as alleged in the complaint.  The complaint is pending since 04/01/2013 to file expert evidence in support of his contention.  The complainant failed to file technical evidence on manufacturing defect.  On perusal of the complaint, it is seen that the complainant has used the vehicle in dispute for three years and the present running is 55,000 kms.  Had there been manufacturing defect, the vehicle would not be run for approximately 55,000 kms.  As the complainant prima-facie failed to establish the deficiency on the part of the opponents, the complaint is not admitted and disposed off in limine.
