ORDER

In the course of arguments of this complaint, the learned counsel representing the O.P. submitted that having regard to the minors interest involved in this case, the O.P. bank has agreed to issue a cheque for the amount due to the deceased in pursuance of the succession certificate issued and submitted that payment of that money may be invested in the name of minors. The counsel representing the complainant submitted for payment of the entire amount in cash to the complainant on the ground that it is neded for the educational expenditure of her children. But, there are 6 minors this case whose interest has to be safe guarded and therefore it is not safe to release the whole amount in favour of the first complainant. As such, we direct the O.P. to invest Rs.25,000/- each in the name of the petitioner No.2 to 7 as mentioned in the succession certificate in F.D. until they attain majority and pay the balance amount in cash to the first petitioner the mother for benefit of the petitioners for their educational expenditure and other needs. With this, the complaint is disposed off and both parties are directed to bear their own costs.
