ORDER:
Today the case was fixed for arguments. Instead of arguing the case, complainant has made a statement that date of filing of complaint is 13.01.2023 and payment has been deposited by the opposite party in the account of the complainant on dated 12.03.2023. Now I only press for the harassment and litigation charges.
On the basis of the statement of Shri Arun Jain son of late Shri Shanti Kumar Jain in person, the Commission is of the opinion that after filing of the complaint, opposite parties have deposited the payment in the account of the complainant on dated 12.04.2023. Opposite parties have harassed the complainant mentally. Hence, opposite parties are negligent on their part. Deficiency of service is proved. . Therefore, the complaint is disposed off with the direction to opposite parties to pay Rs.11,000/- as compensation on account of mental tension, agony and harassment. Opposite parties are also directed to pay Rs.11,000/- as litigation expenses to the complainant. Compliance of this order be made within 30 days from the date of receipt of copy of order. Copy of this order be given to the parties concerned free of costs and file be consigned to record room.
