Heard on the point of admission of complaint.

Briefly, the case of the complainant is that opposite party No.1 Gagandeep Singh has sold the defective tractor model 1994 through opposite party No.2 by undertaking to pay all taxes and challans. Thereafter opposite party No.2 transferred the tractor to the complainant within next 2 weeks.

The averment of the complainant is that opposite party No.1 has not paid due taxes due on his part about Rs.60,000/- per day basis on updating ownership since November 2009. Hence, this complaint.

The complainant has specifically mentioned that he has not complaint against opposite party No.2 Gurdev Singh. He has produced on record copy of affidavit stated to be executed by Gagandeep Singh. As per this affidavit, Gurdev Singh purchased the tractor from Gagandeep Singh. The complainant has not purchased the tractor from Gagandeep Singh. Therefore, he cannot allege any deficiency in service against opposite party No.1. The complainant has also produced on record affidavit of opposite party No.2 Gurdev Singh. As per this affidavit, the complainant has purchased tractor in question from opposite party No.2 Gurdev Singh and Gurdev Singh has taken responsibility for taxes, accident and challans, if any, pending up to date.

The documents relied upon by the complainant show that he has purchased the tractor from opposite party No.2 and opposite party No.2 has taken responsibility to clear all taxes and dues etc., but despite this fact, the complainant has specifically clarified that he has no complaint against opposite party No.2. The complaint is only against opposite party No.1, but the complainant has not purchased the tractor from opposite party No.1. As such, the complaint is not maintainable and stands dismissed in limini. Copy of order be sent to the complainant free of cost and file be consigned to the record.
