1. This is a Review Application filed by Appellants 1 and 2 in Appeal No.1433/2017 to review the order dated 20.07.2022.
2. Heard learned counsel for Appellants 1 and 2 and Respondent is personally present before the Commission.
3. Learned counsel for Review Applicant submits that in Appeal No.1253/2022 passed by this Commission on 22.12.2022 in similar case awarded interest at the rate of 8% p.a.
4. We have gone through this order wherein interest awarded by the District Commission at the rate of 12% p.a is reduced to 8% p.a. But facts remain, it was decided by one member, since Appeal No.1433/2017 decided on 20.07.2022 by two members and this Review Application is filed under section 50 of CP Act, 2019.
5. Let us examine, Section 50 of CP Act, which empower the State Commission to review in a certain cases, any of the order passed by it if there is an error apparent on the face of the record, either of its own motion or on an application made by any of the parties within thirty days of such order.
6. It is to be noted herein that this Review Application is filed after lapse of 641 days cannot be reviewed. Hence, ordered to reject the Review Application as devoid of merits.
7. Send a copy of this Order to the District Commission and the parties concerned.
