Heard Mr. Th. Deepak, learned counsel for the petitioner and Mr. Dijendralal, learned counsel for the respondent at length.
There is some days’ delay in filing the present Revision Petition. However, for the ends of justice, the delay is condoned. We have heard both the parties regarding the merit of the Revision Petition which challenged the impugned order dated 23.09.2022 passed by the learned District Commission, Imphal, in Misc. Case No. 8 of 2022 arising out in the Complaint Case No.14 of 2022
After considering the matter, we are of the considered view that the learned District Commission, Imphal shall dispose of the Misc. Application No. 8 of 2022 on merit afresh in the light of the provisions of Section 38(3)(a) and Section 38 (9) of the Consumer Protection Act, 2019 after hearing both the parties.
The impugned order is hereby set aside.
Registry is directed to send the records of the Complaint Case No.14 of 2022 to the District Commission, Imphal along with a copy of this order.
The revision petition is disposed of.
