ORDER

Per Shri P.N. Kashalkar, Hon’ble Presiding Judicial Member

          There is delay of 7 days in filing this appeal.  To seek condonation of delay, appellant has filed M.A.No.10/697 seeking condonation of delay.  Appellant has stated that he had initially filed appeal with HDFC demand draft, which was not accepted by the State Commission.  The State Commission has directed the appellant that demand draft of nationalized Bank should be tendered along with appeal compilation.  In the process, there is delay of 7 days in filing this appeal.  Condonation of delay application is supported by the affidavit. 

          Considering the fact that delay is of marginal days and delay is not intentional or deliberate, after hearing respondent in person, we are inclined to pass the following order :-

                   -: ORDER :-

1.       Application No.697/2010 is allowed.  Delay is condoned subject to cost of `500/- payable to the respondent.

2.       Appeal No.1095/2010 stands adjourned to 17/01/2011.
