ORDER

Per Mr.S.R.Khanzode, Hon’ble Presiding Judicial Member

There is delay of 4 days.  Reason mentioned is about personal difficulties of the officer who was dealing with the matter.  Name of the official is not mentioned. So, also there is no affidavit of such officer.  Whatever, it may be, the delay is quite small.  Opponent also gives concession to condone the delay subject to payment of cost.  Therefore, we find that delay in the background of given circumstances, it is desirable to condone delay which is not an intentional or malafide and considering the fact that dispute should also be settled on merits.  We hold accordingly and pass the following order :-

             -: ORDER :-

1.  Application is allowed.  Delay is condoned subject to cost of `5,000/- to be payable to the opponent/respondent within 30 days and failing which without any further reference to this Commission application stands dismissed.

2.  Subject to payment of cost as directed, appeal be listed for hearing on admission to 10/12/2010.
