 Final Order

            This complaint is filed by the complainant alleging deficiency in service as well as unfair trade practice against the O.P. Today is fixed for hearing on the point of admissibility. At the time of admission hearing it is seen by us that only the juristic person has been made party in this proceeding. This complaint has not been filed against the O.P in representative capacity. Therefore, as the person/ Chair has not been made party, this complaint cannot be accepted and adjudicated upon in a proper manner. Moreover, the manufacturer of the questioned mobile has not been made party which may cropped up trouble at the time of adjudication of this complaint.

            Due to such difficult we are not in a position to admit the same. Hence C.C. No. 360/2018 is hereby dismissed being defective one and without being admitted. However, the complaint is at liberty to file afresh for redressal of his grievance before appropriate Forum, if any, barred otherwise.

Let plain copy of this order be given to the parties free of cost as per the CPR, 2005.
