Heard the counsel for the complainant regarding maintainability of this complaint. The learned counsel submits that the complainant personalty presented this complaint but has not made New India Assurance Company Limited as a party. Therefore, seeks permission to withdraw this complaint with liberty to file fresh complaint against the necessary O.Ps. with this the complaint is dismissed as withdrawn with liberty to the complaint to the fresh complaint on the same cause of action.
