1. This complaint filed under section 35 of Consumer Protection Act 2019 and stood over to this date for consideration and this Commission passed the following order.

2. This is a complaint filed by the complainant against the opposite party alleging deficiency in service on the part of the opposite party. After admitting the complaint notice was issued to the opposite party. The opposite party entered appearance and filed written version denying the allegations raised by the complainant. Since 21/04/2022 the case was adjourned for the purpose of filing affidavit of the complainant. Since 14/06/2022 the complainant was continuously absent and on 11/08/2022 it was informed that the complainant is no more. Subsequently the case was adjourned for the appearance of legal heirs of the original deceased complainant. As there was no representation from the side of the complainant and no records were available to show that the complainant is no more. On 20/01/2023 this commission issued a notice to the complainant. The said notice issued to the complainant was returned with endorsement “addressee expired ’’. In view of the above discussions, we find that this is a fit case to be dismissed as abated.

                     In the result, the complaint is dismissed as abated. There will be no order as to costs.

             A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
