Heard Mr. J.Sarma, learned counsel, appearing for the petitioner. Notice was sent t the respondent by registered post with A/D. Office note dated 17-7-2014 indicates that A/D card has not returned after due service, yet, the respondent chose not to respond to the notice sent by this Commission. In such circumstances, we have no option but to take up the Misc Case.

            We have heard Mr. J.Sarma, learned counsel, appearing for the petitioner in the application for condonation of delay. We have seen the explanation given in para 2 and we are satisfied that the appellant was prevented from filing the appeal in time. Accordingly, the delay is hereby condoned.
