Final Order / Judgement

            Heard Mr. D. Deka, learned counsel, appearing for the revision petitioner.

            Perused the additional affidavit filed by the revision petitioner for bringing on record the Memorandum of Understanding ( MOU for short) dated 14-8-2015 whereby the parties have amicably settled their disputes. Copy of the MOU has been annexed with the aforesaid additional affidavit, wherein it has been stated that the first party (revision petitioner) has paid to the second party (respondent) a sum of Rs. 45,100/- only vide Demand Draft No. 638692dated 3-6-2015 drawn on UCO Bank towards full and final settlement of all dues of the first party payable to the second party and the second party has acknowledged the receipt of the same and accordingly, the parties have agreed to file an application on the next date before the District Forum to dispose of C.C. Case No. 105/2013 in the light of the terms and conditions of the MOU arrived at between the parties. It has been further stated that they have agreed that henceforth, they shall have no claim(s) against each other regarding the disputes in hand. The parties have signed the MOU in presence of their respective counsel.

            In view of the above, nothing survives for adjudication in the present revision petition. The same is accordingly disposed of.

            Stay order passed by this Commission on 26-2-2015, staying further proceeding of C.C. Case No. 105/2013 is hereby vacated.

            The matter is remitted back to the District Forum for passing necessary order.
