                   Counsel for the respondent states that he is representing the respondent herein i.e. complainant before the District Forum. 

The order under challenge is dated 9.2.15 by which the appellant herein i.e. OP before the District Forum has been proceeded ex-parte.

                    After some arguments, the prayer made in this petition is not opposed by respondent except for costs.

                   I have gone through the reasoning given for non-appearance on 9.2.15 by the appellant/OP.  In view of the reasoning given as well as no objection by Ld. Counsel for respondent, the impugned order passed by the District Forum is set aside subject to payment of costs of Rs.3,500/-. 

It is stated that the next date before District Forum is 2.9.15. 

On the said date, the appellant shall pay the costs to the respondent and file its written statement.  Thereafter the District Forum shall proceed further in the matter in accordance with law.

The appeal stands allowed.

                   A copy of this order as per statutory requirements be sent to the parties free of charge and also to the concerned District Forum and thereafter file be consigned to record room.
