This appeal is filed against the order dated 26.03.2016 passed in Consumer Complaint No.206/2014 on the file of Uttara Kannada District Consumer Disputes Redressal Forum, Karwar.

2. Alleging deficiency of service on the part of the OP in not delivering the RPAD sent on 30.08.2014 to the destination complaint filed against the post office.  The District Forum directed OP to pay Rs.20,180/-, the cost of the Lenovo mobile to the complainant with interest @ 6% p.a. from the date of notice i.e., 27.09.2014 and to pay Rs.3,000/- towards compensation within one month from the date of receipt of the order.
3. Being aggrieved by the said order OPs are in appeal.
4. Heard.  Counsel for appellant submits that Amazon/ addressee to whom the RPAD containing mobile was sent by the respondent/complainant is not made as a party.  He has only made post office as party.  In the circumstances, appeal is allowed and the impugned order is set aside. The matter is remanded to the District Forum to implead Amazon/addressee as party and dispose of the case within three months from the date of receipt of the order. 
5. Parties are directed to appear before the District Forum on 24.01.2022.
6. The amount in deposit is directed to be transferred to the District Forum with a direction to keep the amount in Fixed Deposit till disposal of the case and to do the needful.
