This appeal is filed by OP against order dated 22.05.2015 in Consumer Complaint No.418/2013 on the file of II Additional District Consumer Disputes Redressal Forum, Bangalore.

The brief facts of the case are that the complainant approached the High Court for return of document and admission fee which came to be allowed.  Despite directions of High Court, OP only returned the original marks cards, but, not refunded the admission fees.  It is regarding refund of the admission fee complaint was filed before the District Forum, Bangalore in C.C.No.418/2013.  On account of metal agony and economical loss, the complainant has been awarded with compensation along with damages. 

Heard the counsel for respondent.  Perused the order.  The award as ordered by District Forum is to refund tuition and admission fee of Rs.30,000/- to the complainant and to pay Rs.1.00 lakh towards mental agony on account of non-issuance of certificates.  According to the complainant he could not open petrol bunk as it was a requirement to produce marks cards to commence the business.  For not producing credentials, Hindustan Petroleum Corporation said to have been denied the distributorship to complainant vide letter dated 02.01.2009 and OP deprived the complainant. 

May be one of the criteria to get sanction of open petrol bunk is to produce the degree certificate, but, it alone is not the reason for not getting distributorship.  Thus, we opined that amount awarded at Rs.1.00 lakh towards mental agony is on higher side and the same is reduced to Rs.50,000/-.  Accordingly, the appeal is disposed of.

The amount in deposit is ordered to be transferred to the District Forum for needful.
