The complaint is filed to get back the pledged gold ornaments from the respondent. It is seen that the complaint is not maintainable before the Forum because there is no hiring of service as stipulated under Consumer Protection Act. It is the case that the complainant had pledged with respondent some gold ornaments and the dispute is with regard to interest rate. According to complainant it is a consumer dispute and he has locus standy to approach the Forum. In these kind of cases there is no consumer relationship as stated earlier and the relationship is that of debtor and creditor. The complainant can very well approach concerned civil court for the remedy and the Consumer Forum is not the proper
Forum. Hence the complaint is found not maintainable.
