Today is fixed for hearing of the M.A. case being No. 62/2024 and objection, if any.                              

             Ld. Advocate for the complainant is present.

            Ld. Advocate for the OP No.3 is present.

            M.A. case is taken up for hearing.

            On 03.07.2024 this M.A. case has been filed by the complainant stating that summonses were duly served against the OP Nos. 2 to 4 , except the OP No.1. The complainant has every reason to believe that the OP No.1 is avoiding the service of summons for the reasons, best known to him. Thus, the summons could not be served through post.

The complainant wants to serve summons to the OP No.1 by way of Paper Publication through a daily Circulating vernacular Newspaper and prays for passing an order.

Having heard the Ld. Advocates of both sides, we are of opinion that the M.A. case should be allowed.

Hence, the prayer of the complainant is allowed and M.A. case being No. 62/2024  is thus disposed of.

Complainant is directed to deposit the Draft Copy of Summons to be             served upon the OP No.1 through Paper Publication.

Let a copy of this order be given to the parties on free of cost.

To  06.09.2024  for submission of Draft Copy of the Summons, to be published in a Daily Local Newspaper by the complainant .
