Today is fixed for filing status report from the Hon’ble S.C.D.R.C., W.B. by the Jdr.

 

Ld. Counsel for the Dhr files hazira. The Dhr also files a photocopy of the final Order/Judgment passed by the Hon’ble SCDRC, WB dated 26.03.2019 in the instant First Appeal No. FA/432/2014. The Hon’ble S.C.D.R.C., W.B. was pleased to ‘allow the Appeal on contest against the Respondent in part. The impugned order is hereby set aside. Consequent thereof, the instant complaint case also stands dismissed. In the interest of natural justice, the Respondent is given due liberty to file a fresh case before the Ld. District Forum after arraying the Insurance Compnay into the case within 40 days from today.’

 

In view of such order, the instant Execution Application has lost its force and the Complaint Case has no legs to stand upon.

 

Hence, it is

that the present Execution Application being No.34/2014 be and the same is dismissed in view of the order of Hon’ble S.C.D.R.C., W.B.

 

Let plain copies of this order be supplied to the parties free of cost as per provisions of law.
